1.2 Course description

The function of contracts and contract law; formation of contract, including offer and acceptance, consideration and estoppel, intention to create legal relations and certainty; contents of a contract, including express and implied terms, exemption clauses and statutory control; vitiating factors, including mistake, misrepresentation, duress, undue influence and unconscionability; discharge of contract, including performance, agreement, breach and frustration; remedies, including damages, specific performance, injunctions, action for an agreed sumliquidated damages, deposits, part-payments, rectification and rescission.

Learning Outcomes

2.1 Course Learning Outcomes (CLOs) for this course

CLO 1 Knowledge: By the end of the course, students should be able to demonstrate a solid understanding of the principles of contract law. Students should be skilled in reading contract cases, and be able to critically assess the reasoning and conclusion of the cases.

CLO 2 Problem-solving skills: By the end of the course, students will have had some practice in applying the law to the facts in hypothetical case scenarios, which involves identifying the relevant law for a given factual scenario, applying it to the facts, and distinguishing precedents on material grounds.

CLO 3 Critically thinking skillls: By the end of the course, students will have been given opportunities to analyse and critique contract law principles, doctrines and policies.

CLO 4 Presentation skills: By the end of the course, students will have been given opportunities to present legal arguments effectively, both orally and in writing.

CLO 5 Writing skills: By the end of the course, students will have been given opportunities to write answers to tutorial questions (problems) and to develop and improve their legal writing skills.

LEARNING ACTIVITIES

4.1 Learning Activity Plan

Lecture: 2 hours / week for both semesters
Tutorial: 2 hours tutorial / bi-weekly for both semesters
Private study time: 9.5 hours / week for both semesters

Remarks: the normative student study load per credit unit is 25 ± 5 hours (ie. 150 ± 30 hours for a 6-credit course), which includes all learning activities and experiences within and outside of classroom, and any assessment task and examinations and associated preparations.

4.2 Details of Learning Activities

Weekly two-hour lectures (11 lectures in each of Semester 1 and Semester 2) and bi-weekly two-hour tutorials (5 tutorials in each of Semester 1 and Semester 2).
