1.2 Course description

Introduction to property and land law in Hong Kong, including special features of the New Territories

Acquisition of interests in land: legal and equitable methods, including acquisition from the Government

Concurrent interests under co-ownership, including nature, alteration, and termination of co-ownership, including by partition

Acquisition of possessory title by adverse possession

Priority: enforceability of interests against third parties, including land registration

Leases: nature; creation; termination; relationship of landlord and tenant, including Government leases

Leasehold covenants: nature; enforceability; remedies

Security interests: mortgages; charges

Licences: nature; revocability; enforceability

Easements: nature; creation; termination; enforceability

Learning Outcomes

2.1 Course Learning Outcomes (CLOs) for this course

CLO 1 Explain the legal and equitable doctrines applicable to the ownership and acquisition of interests in land and their rationale, including acquisition from the Government.

CLO 2 Identify problems concerning the acquisition of, and conflicting claims over, interests in land and apply the relevant land law doctrines, including land registration, to solve those problems.

CLO 3 Critically evaluate and synthesize the various land law doctrines and comment on their interrelationship.

CLO 4 Synthesize the various land law doctrines and comment on their interrelationship, especially in relation to high-rise living through the use of deeds of mutual covenants.

CLO 5 Sharpen your communication, presentation, legal research, and problem-solving skills, all of which will be helpful to your career and lifelong learning.

CLO 6 Find your passion and purpose, and decide for yourself what role you want to play in learning and in life.

The Land Law I & II examinations each contribute 50% towards the overall Land Law I & II grade.

Learning Activities

4.1 Learning Activity Plan

Lecture: 2 hours / week for 12 teaching weeks
Tutorial: 1 hour / week for 12 teaching weeks
Private study time: 9.5 hours / week for 12 teaching weeks

Remarks: the normative student study load per credit unit is 25 ± 5 hours (ie. 150  ± 30 hours for a 6-credit course), which includes all learning activities and experiences within and outside of classroom, and any assessment task and examinations and associated preparations.
