1.2 Course description

This course introduces the major issues in labour and employment law in Hong Kong. It examines the legal regulation of the workplace through both common law and statute, including the contract of employment, minimum labour standards, employee entitlements, protection against unfair dismissal, workplace safety, anti-discrimination law, and work-related injuries. The course also considers collective rights, including the right to form and join trade unions, to collectively bargain, and to strike. International labour standards are examined, particularly International Labour Organization conventions and key UN human rights instruments, with attention to their interface with domestic law. The course engages with current global debates on labour precarity, the exploitation of migrant and informal workers, and the legal accountability of multinational corporations for forced labour and rights violations in global supply chains. Comparative perspectives from other common law jurisdictions are integrated throughout.

Learning Activities

4.1 Learning Activity Plan

Seminar: 3 hours / week for 12 teaching weeks
Private study time: 9.5 hours / week for 12 teaching weeks

Remarks: the normative student study load per credit unit is 25 ± 5 hours (ie. 150 ± 30 hours for a 6-credit course), which includes all learning activities and experiences within and outside of classroom, and any assessment task and examinations and associated preparations.
